in respect of the individual Product are provided; "Special Conditions" means
the terms and conditions in the Product Description; "Users" means the users of
the Website collectively; "Personal Information" means the details provided by
you on registration; "We/us" means Golden Gift Logistics; "Website" means the
website located at www.Tofa.af or any subsequent URL which may replace it; Gift
Receiver means an individual identified by you to receive your gift in
Afghanistan at the time you place your order OR Gift Receiver means an
individual that we will identify for you to receive your humanitarian gift
purchased by you.

You are
provided with access to this Website in accordance with these Conditions and any
orders placed by you must be placed strictly in accordance with these
Conditions.
Registration
You warrant that:

are required to provide when you register as a customer is true, accurate,
current and complete in all respects; and
Ø You will notify us immediately of
any changes to the Personal Information by contacting our support@Tofa.af by e-mail.
You agree
not to impersonate any other person or entity or to use a false name or a name
that you are not authorized to use.

We will
treat all your Personal Information as confidential (although we reserve the
right to disclose this information in the circumstances set out below). We will
keep it on a secure server and we will fully comply with all applicable Data
Protection and consumer legislation from time to time in place.
When you
shop on this Website, we will ask you to input and will collect Personal
Information from you such as your name, e-mail address, billing address,
delivery address, telephone number, product selections, credit card or other
payment information and a password. You should be aware that this site is being
monitored and may capture information about your visit that will help us improve
the quality of our service.

your personal (that is your name, address, telephone number, or email address)
unless you provide it voluntarily.

your Personal Information to any company outside of the Golden Gift Logistics.

Indemnity
You agree
fully to indemnify, defend and hold us, and our officers, directors, employees,
agents and suppliers, harmless immediately on demand, from and against all
claims, liability, damages, losses, costs and expenses, including reasonable
legal fees, arising out of any breach of the Conditions by you or any other
liabilities arising out of your use of this Website, or the use by any other
person accessing the Website using your shopping account and / or your Personal
Information.

rights

reserve the right to:

this Website (or any part thereof) with or without notice to you and you confirm
that we shall not be liable to you or any third party for any modification to or
withdrawal of the Website; and / or

Purchase
of products
Orders
We will
take all reasonable care, in so far as it is in our power to do so, to keep the
details of your order and payment secure, but in the absence of negligence on
our part we cannot be held liable for any loss you may suffer if a third party
procures unauthorized access to any data you provide when accessing or ordering
from the Website.
Order
Creation and Electronic Contracting
The
technical steps required creating a contract between you and we Golden Gift
Logistics are as follows:
Ø You place the order for your
products on the web-site by pressing the confirm order button at the end of the
check-out process. You will be guided through the process of placing an order by a series of simple
instructions on the web-site.
Ø We will send to you an order acknowledgement
email detailing the products you have ordered. This is not an order confirmation
or order acceptance from Golden Gift Logistics.
Ø As your product is shipped from our warehouse we will send
you a dispatch confirmation email.
Ø Order acceptance and the completion
of the contract between you and us will take place on the dispatch to the your
designated gift receiver (identified by you at the time of order placement) of
the Products ordered unless we have notified you that we do not accept your
order or you have cancelled it.
The
Non-acceptance could be of one of the following reasons;
Ø
The
product you ordered being unavailable from stock.
Ø
Our
inability to obtain authorization for your payment.
Ø
The
identification of a pricing or
product description error.
Ø
You not
meeting the eligibility to order criteria set out in the main Terms & Conditions.
The
details of your specific contract will not be filed by Golden Gift Logistics

Order
Cancellation/Refunds/Exchanges
With a
valid reason a Gift Receiver or the customer may exchange the gift within 8
working days from the date of receipt.
Any products returned must be in their original packaging, and unused.
Golden Gift Logistics T/A Tofa.af completely holds the right to evaluate
the returned gifts and based on its own conclusions reject any returns even the
above condition is met.
Perishable gifts
and edible gifts cannot be exchanged or refunded at all. Items that have been
worn, ironed, steamed or washed will not be accepted as returns or exchanges.
Outfits that have any stains, emit body odors or perfume scents, have any kind
of iron marks or water stains will not be accepted for returns or exchanges.
A refund will only be made if the gift cannot be procured or delivered at
all. This will be extremely rare as we have a dedicated team on procurement who
will update the website on a daily basis.
All delivery areas are controlled by drop downs.
We do not accept gifts to delivery areas that cannot be handled.
For any exchange, Delivery Charges will not be funded.
A minimum of 15% handling fee will be charged for all refunds and
exchanges. Custom (ordered to
your own specifications) are not exchangeable or refundable at all.
When you
place an order for flowers, should you realize you have made a mistake or change
your mind, we are able to amend or cancel your order within one hour of it being
placed. We regret we are unable to do so after this time.
Notwithstanding any or all of the Terms, Conditions & Disclaimers stated herein
above and in FAQ or elsewhere in the tofa.af website, any refund or payment by
Tofa.af to the user or anyone else acting on his behalf for any reason
whatsoever, voluntarily or on being claimed by any user shall not become a
waiver of any or all of the Terms, Conditions and Disclaimers made and shall not
become a precedent for similar future actions/claims or confer any rights on the
claimant.
Description of products
Tofa.af makes every
effort to ensure that the product descriptions and photographs provided on this
web site are accurate and life-like. Whilst the reproduction of colours and
styles contained on the photographs shown on this website are as accurate as
image and photographic processing will allow, Tofa.af cannot accept
responsibility for slight variances in colour or style. However, as the actual
colours you see will depend on your monitor, VGA card, resolution of your
computer, browser used. We cannot guarantee that your monitor's display of any
colour will be accurate
Each Product purchased is sold subject to its Product
Description which sets out additional Specific Conditions related to that
Product including, without limitation, terms and conditions concerning estimated
delivery dates and times, warranties, after-sales service and guarantees.
We will take all reasonable care to ensure that all
details, descriptions and prices of Products appearing on the Website are
correct at the time when the relevant information was entered onto the system.
Although we aim to keep the Website as up to date as possible, the information
including Product Descriptions appearing on this Website at a particular time
may not always reflect the position exactly at the moment you place an order. We
cannot confirm the price of a Product until your order is accepted in accordance
with our Order acceptance policy.
Warrenties
Product/services/gifts provided on this site are without warranties of any kind
either expressed or implied and Tofa.af website disclaims all or any of them to
the fullest extent. Tofa.af does not warrant that the products/services/gifts
offered will be error-free, or that the defects will be corrected, or that this
site or the server that makes it available are or will be free of viruses or
other harmful components. Any warranties or After Sale Services if any offered
by the Manufacturers/Vendors on any product shall be serviced directly by such
Manufacturer/Vendor and Tofa.af shall not be under any obligation to ensure
compliance or handle complaints.
Flowers/Cakes/Cookies
In the
event of supply difficulties, we reserve the right to substitute goods or
packaging of equal quality and value. Complaints about the flowers and cakes and
any persihable items should register within an hour of delivery. Any complaints
after that will not be considered. These items needs to keep in cool
temperature.
For Flowers, Sweets or other items that are perishable in nature,
the delivery would be attempted only once. If the delivery is not executed
during that attempt due to incorrect or insufficient address, recipient not at
home, address found locked or refusal to accept, the customer shall still be
charged for the order. No refunds or exchanges of any kind would be entertained
for such items.
Since
flower arrangements and cakes are hand-made and decorated, there may be a slight
variation from the pictures shown. However we will make sure that we deliver the
gift as close as possible to the description/ photograph shown.
Electronics
Products
listed in our 'Electronics' section are purchased directly from the authorized
dealers. If there is any technical fault after use, it will be covered under the
warranty provided by the manufacturers, but these products cannot be replaced
due to any other reason such as changing it with a different model or returning
due to any other non-technical issue.
Payment
All
prices are correct at the time of entering the information onto the system. The
total cost of your order is the price of the Products ordered plus delivery
charges as set out in the Delivery section of this Website.
You will be notified by email in case any
adjustments need to be made to the delivery charges.
This situation can arise if the location of your gift receiver changes or
conditions to reach the gift receiver causes extra costs to Tofa.af.
You will not be charged any amounts unless and until you have approved
the adjustment amounts.
Payment
can be made by any of the methods specified in the Payment section of this
Website and payment will be debited and cleared from your account as set out in
the Payment section of this Website.
You
confirm that the credit, debit card that is being used is yours.
All
credit/debit cardholders are subject to validation checks and authorization by
the card issuer. If the issuer of your payment card refuses to or does not, for
any reason, authorize payment to us, we will not be liable for any delay or
non-delivery.

Currency
Exchange
Tofa.af
is obligated under the laws of the Afghan Government of complete any and all
transactions in the legal currency of Afghanistan, the “Afghani”.
Since all product purchases are in US Dollars on the website, Tofa.af
will convert all transactions to its equivalent amount in Afghani.
The rate of exchange will be according to market rates but the actual
rates will be determined and applied at the sole discretion of Tofa.af.

Refusal
of Transaction
We
reserve the right to withdraw any Products from this Website at any time and/or
remove or edit any materials or content on this Website. We may refuse to
process a transaction for any reason or refuse service to anyone at any time at
our sole discretion. We will not be liable to you or any third party by reason
of our withdrawing any Product from this Website whether or not that Product has
been sold; removing or editing any materials or content on the Website; refusing
to process a transaction or unwinding or suspending any transaction after
processing has begun.
By making
an offer to buy a Product, you specifically authorize us to transmit information
(including any updated information) or to obtain information about you from
third parties from time to time, including but not limited to your debit or
credit card number or credit reports, to authenticate your identity, to validate
your credit card, to obtain an initial credit card authorization and to
authorize individual purchase transactions.
We only
cater for overseas for deliveries to Afghanistan. We, at our own sole
discretion, may not accept any credit card transactions from Afghanistan.
When you
place an order for flowers, should you realize you have made a mistake or change

placed. We regret we are unable to do so after this time.
Delivery
Dates and Times
Golden Gift Logistics does not guarantee the delivery date
specified by the sender. Golden Gift Logistics will dispatch gift items within
48 working hours of receiving the order. If sender specifies a particular
delivery date, Golden Gift Logistics will postpone the dispatching of the gift
item until such a date that it reaches around the specified date of the sender.
In any circumstances, Golden Gift Logistics does not guarantee the exact date of
delivery specified by the sender. The date of delivery may vary according to the
efficiency of respective couriers by which the gift items are dispatched and the
remoteness of the recipient.
The normal delivery time of the product ordered is between 9:00
am to 8:00 pm.
Golden Gift Logistics is not responsible for missed/late
deliveries due to curfews, acts of government, acts of nature, holidays,
incorrect addresses or acts of war.
Refusal
to Deliver
We
reserve the right to not deliver to certain locations within Afghanistan where
we determine that the safety of our staff or anyone associated with us could be
at risk. In these cases, you will be
notified and alternatives will be provided.
Alternatives include: Gift
Receiver picking up his gift from the tofa.af offices or the Gift Receiver
picking up his gift from an agreed upon safe meeting point.
Tofa.af
will return to its office any gift that is refused by the Gift Receiver for
whatever reason. Tofa,af
delivery agent will attempt to document the reason for refusal to accept the
gift and will notify you of the reason, if given.
No refunds, exchanges can be given for any gift being refused by the Gift
Receiver.
High
Value Transactions
All high value transactions such as mobile phones and
electronics cannot be shipped until transaction has been cleared by the bank –
however long that process may take.
We also verify each high value transaction by calling the person, if you have
provided wrong information that could delay your delivery and delivery will not
be made until correct details are provided by buyer. For any high value
transactions, we may also ask for the proof of address and copy of credit card
statement used in that transaction.
Agreement
to Terms and Conditions
THE USER OF TOFA.AF IS PRESUMED TO HAVE READ ALL THE TERMS AND
CONDITIONS HEREIN AND FAQ AND IS DEEMED TO HAVE AGREED, UNDERSTOOD AND ACCEPTED
UNCONDITIONALLY ALL THE TERMS, CONDITIONS, PROCEDURES AND RISKS OF USING THE
SERVICES AND CAN NOT AT ANY TIME CLAIM IGNORANCE OF ANY OR ALL OF THEM. ALL
RELATIONSHIP OF ANY USER WHERESOEVER SITUATED IS GOVERNED BY AND IN ACCORDANCE
WITH THE LAWS OF THE GOVERNMENT OF AFGHANISTAN.
